House Extensions in Brough

House Extensions in Brough

On newer estate housing the standard permitted development rights are not always there. A condition on the original permission for the estate can remove them, and almost nobody keeps the decision notice for a house they bought second hand. That check is the first thing we do, because it decides the whole route.

Before You Design

the rights you may not have.

Householder permitted development lets you extend within fixed limits on depth, height and eaves height without any planning judgement being applied. It is a national default, but there are several ways for a particular house to lose it. A condition on the original planning permission for an estate can remove some or all householder rights, usually to protect the layout and the spacing the estate was approved on. An Article 4 direction can do the same across a defined area. Rights do not apply to flats and maisonettes at all, and they are reduced on designated land.

The reason this bites hardest on newer housing is simply that the paperwork is a generation old and nobody reads it. A homeowner assumes the standard rules, a builder assumes the same, and the first anyone hears about it is an enforcement enquiry or a solicitor's question at sale. It takes very little effort to check the planning history properly, and it changes the design brief when the answer comes back.

Losing the rights is not a refusal. It means the scheme goes in as a full application and gets judged on its merits, which is a longer route and a different kind of drawing set. It is entirely workable when it is known at the start.

  • Planning history and condition check for the specific address
  • Article 4 direction and designated land checks
  • Lawful development certificates where the rights do apply
  • Full householder applications where they have been removed
  • Prior approval submissions for larger single storey rear extensions

Our Process

how we work.

01

Planning History

We look up the permissions and conditions attached to your address before anything else happens.

02

Site Visit

Measured survey of the house and plot, with levels, boundaries and drainage recorded.

03

Route

Permitted development, prior approval, or a full application to East Riding of Yorkshire Council, decided on evidence.

04

Design

Options developed inside whatever the route allows, rather than drawn first and squeezed in afterwards.

05

Approvals

Submission, officer correspondence, building regulations, and party wall notices where they apply.

06

Build

Built by the practice that designed it, to the figure quoted before you committed.

Brough

check the rights before you assume them.

Permitted development is the default, not a guarantee. On estate housing it is regularly removed by a condition that nobody has read since the estate was built.

The Local Stock

extending on an estate, and along the humber.

Brough sits on the north bank of the Humber and has a wide mixture of housing, from older property near its centre out to substantial areas of modern estate development. Modern houses extend well in some respects, because the construction is documented, the foundations are usually adequate and the drainage is recorded. They constrain you in others, because plots are tighter, the gap between houses is often narrow, and the estate layout was approved as a whole.

On a tight plot the practical questions come quickly. Whether there is access to the rear without going through the house, which decides how the build is run. Whether an extension to the side leaves room to maintain the wall from your own land. And how much of the original garden is already covered, since that proportion is capped under permitted development and modern gardens are not large. A well planned single storey rear extension or an over-garage addition usually gets more out of this stock than a sprawling scheme would.

  • Single storey rear extensions planned around a compact garden
  • Over-garage and side extensions where the gap genuinely allows
  • Two storey extensions assessed for bulk, spacing and overlooking
  • Access and build sequencing worked out for a plot with no side gate
  • Internal reconfiguration where the plot cannot take much more footprint

Technical

what building regulations will want.

Planning and building regulations are separate approvals and a scheme can have one without being close to the other. Building regulations cover foundations, structure, insulation, airtightness, ventilation, fire escape and drainage, and they apply whether or not a planning application was needed. On a modern house the existing fabric is generally better than on an older one, which makes the junction between old and new easier but raises the standard the new work has to meet.

Drainage is worth checking early even where the records look clean. Where a public sewer or a shared lateral drain runs under the garden, a build over agreement with the water authority is normally required and the foundation design has to respond. Estate drainage is often shared between several properties, so a run that looks private on a plan may not be.

  • Building regulations drawings, calculations and inspection stages
  • Drainage survey and build over agreement with the water authority
  • Insulation, airtightness and ventilation designed alongside the glazing
  • Structural openings between old and new sized with the engineer
  • Party wall notices where the work reaches a shared or boundary wall

Questions

house extensions in brough, answered.

Which council handles extensions in Brough?

East Riding of Yorkshire Council. Brough is outside the Hull city boundary, so applications are determined under the East Riding local plan rather than by Hull City Council. We submit through the Planning Portal and correspond with the case officer directly.

How do I find out whether my permitted development rights were removed?

By checking the planning history for the address, including the original permission for the estate and any conditions attached to it. The council's online planning register holds most of it. We do that search before recommending a route, because it changes both the timescale and the drawings.

What happens if I build under permitted development and it turns out I could not?

It becomes unauthorised development, which can lead to an enforcement enquiry and a retrospective application, and it will certainly come up when the house is sold. That is why a lawful development certificate is worth having even when you are confident, since it is a written answer rather than an assumption.

Is a modern house easier to extend than an older one?

In some ways. The construction is documented, the foundations are usually adequate and the drainage is recorded, so there are fewer surprises when the trench opens. The constraints are different: tighter plots, narrower gaps between houses and less garden to spend on footprint.

There is no side access to my garden. Does that matter?

It affects how the build is run rather than whether it can happen. Materials and spoil come through the house or over the scaffold, which changes the sequence, the protection needed inside and the length of the disruptive period. We price and programme that in rather than treat it as a surprise.

How much of my garden can I build on?

Permitted development caps the proportion of the original garden area covered by buildings, and existing sheds and garages count towards it. On a compact modern plot that limit often bites before the depth limit does, which is why it is measured properly at the survey.

Do I need a party wall agreement on a detached house?

You can still need one. Building up to the line of junction with a neighbour, or excavating foundations within the distances set out in the Party Wall etc. Act and below the level of their foundations, both require notice even where no wall is shared. It depends on where the work sits, not on the house type.

Can I extend over the garage?

Often, if the garage foundations and walls will carry the new floor and roof. On modern housing that is more likely than on older stock, but it is still assessed rather than assumed. Where the structure falls short, strengthening or a new beam over the opening is the usual answer.

Will the extension need to match the estate's materials?

Where a full application is needed, materials are a planning consideration and the council will look at how the extension sits with the house and with the street. On modern estates the brick and roof tile are usually still available or closely matchable, which makes that part more straightforward than it is on older property.

Do you work in the villages around Brough?

Yes. North Ferriby, Swanland, Hessle, Kirk Ella and Anlaby are all within the same authority and we work across them, as well as into Hull. The policy framework is shared while the housing stock varies a great deal between them.

Do you design and build, or subcontract the construction?

We do both ourselves. The architect who designs the extension oversees the site work, which is the whole point of an architect-led design and build practice. The detail drawn is the detail built, and the build figure quoted at the outset is the one we stick to.

How long does the process take from first visit to finished?

Where a full application is needed, allow eight weeks for determination after validation, plus the design and submission time before it and building regulations alongside. Construction is weeks for a single storey scheme and months for two storey work. We set out a programme with the quote.
